Baltimore, Maryland: Brett Weiss and
Daniel Press, Washington area attorneys, announced the filing of a national
class action lawsuit against Norwest Mortgage, Inc. in the U.S. Bankruptcy Court
for the District of Maryland, Baltimore Division. The suit alleges that Norwest
has filed Proofs of Claim in at least 5,000 Chapter 13 cases across the country
seeking interest on pre-petition arrearages at rates higher than those allowed
by the underlying mortgages or applicable law. Chapter 13 Trustees administering
cases where such proofs of claim were filed are also named as necessary parties.
The Complaint seeks a national objection to these Proofs of Claim, declaratory
and injunctive relief, equitable subordination of Norwest's claims, and
compensatory and punitive damages of 1.5 billion dollars.

“Norwest’s actions target those least able to resist,” Press said. Weiss
pointed out, “Debtors in bankruptcy are being forced to pay Norwest more than
they should and, even worse, some have lost their homes as a result.” Noting
that Norwest is the largest residential mortgage lender in the country, Weiss
added, “They should know better.”
