Will: (RN = 85) Jean Cathey of Mecklenburg County, North Carolina
March 9, 1777
In the name of God, Amen, I, Jane Cathey, being in a low state of health at
present, but blessings be to God enjoying as yet a sound mind and a disposing
memory, and I do now constitute, ordain, and appoint this to be my last Will and
Testament in manner and form following, to wit: First of all I give and bequeath
my spirit to god who gave it, hoping for acceptance in and the purchase of Jesus
Christ my Lord, and as touching my worldly affairs, they are to be disposed of in
manner and form following, to wit: First item - I give and bequeath my body to the
dust to be buried in a decent Christian like manner and then all of my debts and
funeral charges to be paid out of my Estate by my Executors hereafter mentioned.
Item. I give and bequeath to my son Andrew Cathey's son, Alexander Cathey, the
negro wench called Sylvia as my son Archibald had directed in his life time
provided he pay 60 pounds in money, that is to say 1/6th part to my son Andrew
Cathey, 1/6th part to my son George Cathey, 1/6th part to my grandson John Tool
and Elizabeth Williams, 1/6th part to Thomas Cathey Brawley and Andrew
Anderson Wallace to be equally divided between them, and 1/6th part to Joseph
McGoon and Hugh McGoon equally divided between them. Item. I give and
bequeath to my son John Cathey's Son, Arch'd Cathey, the negro wench Jude, he
paying the sum of 40 pounds, that is to say, 1/6th part to be paid to my son John,
1/6th part to my son Andrew. 1/6th part to my son George Cathey, and 1/6th part
to Thomas Cathey Brawley and Andrew Anderson Wallace, and 1/6th part to John
Tool and Elizabeth Williams, and 1/6th part to Joseph McGoon and Hugh McGoon.
Item. I give and bequeath to my son George Cathey's son, George, the negro
wench called Rachel, provided he pay the sum of 20 pounds, that is to say, to my
son John 1/6th part, to my son Andrew 1/6th part, 1/6th part to my son George and
1/6th part to Thomas Cathey Brawley and Andrew Anderson Wallace, and 1/6th
part to John Tool and Elizabeth Williams, and 1/6th part to Joseph McGoon and
Hugh McGoon, and all the rest of my worldly goods to be equally divided in six
shares between my son John, 1/6th part, to son Andrew 1/6th part, to my son
George 1/6th part, and 1/6th part to John Tool and Elizabeth Williams, 1/6th part
to Thomas Cathey Brawley and Andrew Anderson Wallace, 1/6th part to Joseph
and Hugh McGoon. Except my feather bed and furniture I have and bequeath to
Mary John Chambers and all my own clothes to be equally divided between my two
daughters, to wit: Eleanor Williams and Esther McGoon, and also I give and
bequeath to Alexander Long and Joseph Chambers one year old sorrel filly, and in
case Thomas Cathey Brawley and Andrew Anderson Wallace both die before they
come to age, then and in that case their part is to be divided between John Tool and
Elizabeth Williams one half, and Joseph and Hugh McGoon the other half. And
lastly, I do now revoke and disannul all wills herebefore made by me and do now
constitute, ordain and declare this and this only to be my last Will and Testament.
In witness thereof I have hereunto set my hand and affixed my seal this 9th day of
March, 1777. N.B. I do appoint my trusty and well beloved son George Cathey and
Robert Irwin to be my whole and sole executors of this my last Will and Testament,
and I also give and bequeath to my daughter Eleanor Williams a certain Dun low
with cut horns, all to which I have set my hand and seal this the day and year above
written.
