1.  DOCUMENTATION:  When this contract is signed and returned, BLACK FOX FARM will send the mare owner a Mare Identification Form and a Mare Breeding Passport. The Mare Identification Form and the Mare Identification page of the Mare Breeding Passport must be filled out by the mare owner. The Mare Identification Form must be returned to BLACK FOX FARM before delivery of the live semen. The Mare Breeding Passport must be filled out by the veterinarian on the day(s) of insemination and pregnancy checks and be returned to BLACK FOX FARM after the final pregnancy check or before November 30. A Delivery and Insemination Certificate For Transported Semen will be sent with each shipment of semen. The Certificate must be completed by the veterinarian on the day of insemination. The mare owner must return the Semen Container, with the completed Delivery and Insemination Certificate, within 24 hours of receipt of the transported semen.

 

2.  PRE-SHIPMENT STEPS: In addition to the signed contract and the Mare Identification Form (see section 1), BLACK FOX FARM must receive the $1000 stud fee and a $350 deposit on the Semen Collection before live semen will be shipped to the mare owner. A current uterine culture (taken when the mare is in heat, and submitted to a licensed laboratory) is also recommended. No part of the stud fee will be returned after at least one shipment is made. The only exception is section 8.

 

3. If more than two shipments of live semen are required, the mare owner will be charged $175 for each additional collection.

 

4.  LIVE FOAL GUARANTEE: It is agreed that, under this contract, a live foal will be guaranteed from the transported semen for a maximum of three consecutive breeding seasons. A live foal is defined as a newborn foal, which stands and nurses. If the foal is born dead, return privileges may be exercised by the mare owner for the following    season. However, Lisa A. Reid (Agent) must be notified within seventy-two (72) hours from the foaling date, and receive a veterinarian's statement concerning the circumstances of death within ten (10) days of the foaling date. If the mare dies or after examination by two licensed veterinarians is found to be unfit to breed, another mare may be substituted with the consent of BLACK FOX FARM. If the mare is examined by a licensed veterinarian and found to be barren fifty (50) to seventy (70) days from the last insemination, return privileges are also granted. If, after two full breeding seasons the mare has not conceived, the mare owner may substitute another mare with the consent of BLACK FOX FARM. In any event, no more than three consecutive breeding seasons will be honored.

 

5. It is understood that the transported semen may be used only for the mare designated on this contract and that all excess semen must be destroyed. Should the semen be used on a mare other than the mare designated on this contract without Lisa A. Reid's (Agent) written permission, this contract becomes null and void.

 

6. It is understood that no semen will be collected or shipped after July 31 except under special circumstances and that $200 will be charged for each collection.

 

7. A licensed veterinarian must examine the mare fifty (50) to seventy (70) days after the last insemination date and advise BLACK FOX FARM in writing of the mare's pregnancy status or the live foal guarantee of this contract shall be null and void.

 

8.     Lisa A. Reid (Agent) and BLACK FOX FARM assume responsibility only to deliver live semen in viable condition at the

      time of delivery to the mare owner or his or her designee. A licensed veterinarian must administer the semen on the day   

      of delivery; otherwise, all conditions of this contract become null and void.

 

9. Should BFF IN DISGUISE /*/*/*/ / / die, become unfit for service, or be sold, the stud fee or deposit paid will be refunded if the mare does not produce a live foal.

 

10. This contract is in duplicate. The mare owner must fill out and sign both copies and return them to BLACK FOX FARM. When Lisa A. Reid (Agent) signs and returns one copy of this contract to the mare owner, it will then be a binding contract on both parties, subject to all above terms and conditions. This contract may not be assigned or transferred by the mare owner.
